The EEOC issued final regulations for Title II of the Genetic Information Nondiscrimination Act (GINA). Title II of GINA prohibits employment discrimination on the basis of genetic information and took effect on November 21, 2009. The final regulations are effective January 10, 2011.

The regulations provide guidance for employers on the definition of terms used in the law, information on an employer’s “inadvertent” acquisition of genetic information, examples of tests that are, or are not, considered genetic tests, as well as model “safe harbor” language for employers to include in any requests for medical information.
