Bush Makes NLRB Appointments

President Bush has made two “recess” appointments to the National Labor Relations Board, giving the board a Republican majority.

Bush made the appointments just a day before the opening of the second session of the 107th Congress. Because Bush exercised his authority while Congress was out of session, his appointees will be allowed to serve until Congress recesses again at the end of the year.

The two appointees are Michael J. Bartlett and William B. Cowen.

Bartlett is director of Labor Law Policy at the U.S. Chamber of Commerce, a position he has held since 1998. From 1987 to 1995, he was a partner and special counsel with Verner, Liipfert, Bernhard, McPherson & Hand in Washington, D.C., following two years as vice president for employee relations and labor counsel for Eastern Airlines. He was a partner with Ogletree, Deakins, Nash, Smoak & Stewart from 1980 to 1986, following six years with Vedder, Price, Kaufman, Kammholz & Day. Bartlett was an attorney in the office of general counsel for the National Labor Relations Board from 1969 to 1971. He has a BA from Amherst College and a JD from the University of Virginia.

Cowen is currently principal attorney for Institutional Labor Advisors, LLC, a company he founded in 1997. He previously was a founding member of Cowen and Associates, where he worked from 1996 to 1998, following four years with Coleman, Coxson, Penello, Fogleman & Cowen, P.C. From 1985 to 1992, Cowen was with Thompson and Hudson.

From September 1979 to August 1985, Cowen served in various capacities at the National Labor Relations Board in various positions, including counsel to board member Howard Jenkins, Jr., and as a field attorney in Cleveland, Ohio. Cowen has a BA from Case Western Reserve University and a JD from Cleveland State University.
