The firm had failed to record the hours worked by salaried, non-exempt employees-primarily
customer sales associates-and failed to pay them overtime when they worked
over 40 hours in one workweek, said George Friday, deputy regional administrator
for the DOL's Wage Hour Division in San Francisco.
Other job categories involved in the case included order management specialist,
service partner contract administrator, sales operations specialist, and payroll
manager, according to the DOL.
The investigation covered the period from March 1, 2002, until March 1, 2004.
Under the FLSA, employers must pay covered workers at a rate of at least one
and one-half times their regular rate of pay after 40 hours in a workweek and
must maintain accurate records about employees, their hours worked, and their
wages earned.
The Wage and Hour Division reports recovering more than $212 million in back
wages in fiscal year (FY) 2003, a 21 percent increase over the record setting
amount of FY 2002. Average days to resolve a complaint decreased in FY 2003
from 129 days to 108 days. The division assessed employers nearly $10 million
in civil money penalties in FY 2003.
